Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern access to and use of the call tracking, call routing, recording, SIP trunking, browser-based calling, and related services (the "Service") operated by Root Telemarketing LLC ("Root Telemarketing," "we," "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the business you represent ("you," "Client").
2. The Service
The Service lets you provision phone numbers, track and route inbound and outbound calls, record calls where enabled, connect your own SIP trunk, place and receive calls from a browser-based softphone, and manage contacts, campaigns, and usage reporting. Some features depend on third-party infrastructure described in Section 7.
3. Accounts
You're responsible for the accuracy of the information on your account, for safeguarding your login credentials (including any two-factor authentication method you enable), and for all activity that occurs under your account. Notify us immediately at sale@test11.dataposting.online if you suspect unauthorized access.
4. Wallet, Billing & Charges
- Usage (calls, minutes, recording storage, number purchases) is billed against a prepaid wallet balance associated with your account.
- Rates are shown on the Pricing page or in your account's pricing settings and may be updated with notice.
- If your balance reaches zero, new outbound calls and number purchases may be blocked until the account is topped up.
- Charges are calculated from actual call and messaging usage recorded by the Service and its underlying carrier. Except where required by law, wallet funds and charges are non-refundable once usage has occurred.
5. Your Responsibilities
You are solely responsible for how you use the Service to contact people, including:
- Obtaining any consent required to record calls under the laws of the jurisdictions you and the people you call are in (including "two-party consent" states/countries).
- Complying with Do Not Call laws and registries (such as the U.S. TCPA and National DNC Registry), telemarketing regulations, and caller ID rules.
- Only calling or texting numbers you have a lawful basis to contact, and honoring opt-out requests.
- Maintaining accurate Do Not Call suppression lists using the tools the Service provides.
The Service provides tools (internal DNC lists, third-party DNC scrubbing, call recording controls) to help with compliance, but using those tools correctly, and complying with applicable law, remains your responsibility.
6. Acceptable Use
Use of the Service is also governed by our Acceptable Use Policy, which is part of these Terms.
7. Third-Party Services
The Service relies on third-party providers to function, currently including Twilio (telephony, SMS, call recording storage, and SIP trunking infrastructure) and DNC Boss (Do Not Call registry scrubbing). Your use of the Service means your call and messaging data will pass through these providers as needed to deliver the Service. We choose and configure these providers but do not control their networks or uptime.
8. Intellectual Property
Root Telemarketing retains all rights to the Service's software, design, and branding. You retain ownership of your own account data, contacts, and recordings.
9. Suspension & Termination
We may suspend or terminate access to the Service for violation of these Terms or the Acceptable Use Policy, non-payment, or suspected fraudulent or illegal activity. You may stop using the Service at any time.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, except as expressly stated here or in a separate written agreement. We do not guarantee uninterrupted or error-free operation, as call delivery depends in part on third-party carrier networks outside our control.
11. Limitation of Liability
To the maximum extent permitted by law, Root Telemarketing will not be liable for indirect, incidental, special, or consequential damages arising from use of the Service, including lost revenue or lost calls, even if advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold Root Telemarketing harmless from claims arising out of your use of the Service in violation of these Terms, applicable law, or the rights of any third party (including people you call or message).
13. Governing Law
These Terms are governed by the laws of [Root Telemarketing LLC's state/country of incorporation — to be finalized], without regard to conflict-of-law principles.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above.
